UP State Bar Council Writes to Allahabad High Court Acting Chief Justice to Grant Interim Bail/Parole for the Under trials Based on Human Right Considerations

Over Crowding in U.P. Jails resulting in doubling of infection rate among prisoners

In a bid to reduce congestion in jails, U.P. State Bar Council has written a letter to the Hon'ble Acting Chief Justice of Allahabad High Court. The letter addressed to Chief Justice Sanjay Yadav highlights the lethal problem of doubling of infection rate in the last 2 weeks due to overcrowded jails in UP. As a result of the congestion in U.P. Jails, scores of inmates have tested positive for the virus. 

Interim bail/ parole need of the hour

Citing human right considerations, the State Bar Council has requested the acting Chief Justice of Allahabad HC to grant interim bail/ parole for the under trial/ convict to safeguard the life and health of the prisoners.

Similar policy decision proved successful in breaking the chain of virus earlier

In its letter, the Uttar Pradesh State Bar Council has reminded Justice Sanjay Yadav of a similar policy decision taken by the State Government based on the recommendations of a high powered committee. The said committee had prescribed the release of the undertrial prisoners/ convict for the offences for which prescribed punishment is up to seven years or less with or without a fine.

The decision proved to be successful and led to the decongestion of jails across the State of U.P. thereby breaking the chain of virus and saving the lives of thousands of prisoners.  

Jails in Uttar Pradesh not safe in current situation

Before concluding the request in the letter, the Uttar Pradesh State Bar Council reiterated that the prevailing conditions in U.P.  jails are not fit for human life and safety. Therefore, it is imperative to take judicial notice of the situation and pass appropriate orders based on human right considerations.
