The future of dispute resolution in India is shaped by several evolving factors, including the adoption of technology, reforms in the judicial system, changes in legal practices, and a growing emphasis on alternative dispute resolution (ADR).
Referring to Chanakya's Arthashastra, Shweta Bharti, Managing Partner, Hammurabi And Solomon called it an insightful document describing India's polity, economy and statecraft.
She talked about other kingdoms, rulers and their mediation principles, which are relevant today.
Regarding alternate dispute resolution, Bharti pointed out changing it with ‘appropriate dispute resolution’.
Bharti also highlighted the significance of technology in resolving minor dispute resolution which can save time and resources as well. She also called AI a game changer in arbitration and mediation.
She mentioned the importance of ODF (Online Dispute Facilitation) which leverages the technology to assist and resolve disputes. She called the expansion of ODF beneficial in e-commerce areas like employment disputes and fraud cases.
Bharti concluded that counting technology has immense potential to transform and improve the future of dispute resolution, making it more efficient, accessible, and transparent.
