The legal profession in India stands at a critical juncture, navigating a rapidly changing landscape shaped by technological advancements, increasing caseloads, and the evolving needs of society. In a keynote address, Dr Lalit Bhasin, Managing Partner at Bhasin & Co. and President of the Society of Indian Law Firms (SILF), offered insightful commentary on the state of the legal profession in India. Speaking at a prominent gathering of legal professionals, Dr Bhasin addressed pressing issues such as arbitration inefficiencies, professional ethics, and the importance of fostering institutional frameworks.
Dr Bhasin opened his address with a reflection on his long-standing association with the event, sharing his experience as the jury chair for awards recognising excellence in law. He emphasised the rigorous and transparent selection process, highlighting the importance of rewarding merit and fostering professional growth among both young and seasoned legal practitioners.
Turning his focus to the legal profession, Dr Bhasin lauded the vibrancy of young lawyers, noting that their enthusiasm and innovative spirit continue to inspire him even at the age of 86. He credited events like these for creating platforms where the legal fraternity can exchange ideas and collaborate.
A significant portion of Dr Bhasin's address was devoted to arbitration, which he described as a failed alternative to traditional litigation in India. “Litigation has totally failed,” he said, citing the staggering backlog of over six crore cases in Indian courts. Even with advancements such as virtual hearings and ease of filing cases, the disposal rate remains alarmingly low.
