Delhi HC Issues Injunction Against Counterfeit Skechers Products

The court recognized the potential for consumer confusion and possible harm to Skechers’ brand reputation.

The Delhi High Court recently issued an ex parte interim injunction to protect the trademarks and copyrights of Skechers South Asia. The suit, filed by Skechers, alleged that Delhi Polymer, Subhash Footwear and Gaurav Footwear have been manufacturing and selling counterfiet products bearing Sklechers trademark and designs. 

Justice Amit Bansal, presiding over the case. acknowledged the strong prima facie evidence presented by Sketchers, including detailed reports and photographs of the alleged counterfiet goods discovered after investigation. The court recognized the potential for consumer confusion and possible harm to Skechers’ brand reputation.

The court granted several reliefs to Skechers, including:

  • An order restraining the defendants from using Skechers' trademarks or similar imitations on their products.

  • Appointment of Local Commissioners to inspect the defendants' premises, seize counterfeit goods, and secure business records.

  • A directive for defendants to disclose all entities involved in the production and distribution of these counterfeit items.

Similarly, the Bombay High Court on 24 October 2024, granted relief to Skechers against certain infringers located in Nashik and Indore engaged in sale of counterfeit / lookalike footwear bearing various Skechers trade marks, by granting ex-parte Injunction order and search and seizure of counterfeit products.
