Huawei faces infringement claim over patent for congestion management.
Huawei Technologies Co. Ltd. and Huawei Technologies USA Inc. collectively referred to as Huawei) are being sued for patent infringement. WSOU Investments, LLC (Brazos licensing) filed a complaint in the Western District of Texas. The company alleges that Huawei has infringed the patent-in-suit by utilizing each element in at least claim 1 of the patent for congestion management. The company has also served a notice to Huawei in this regard.
The patent in question is United States Patent No. 6,839,321 titled “domain-based congestion management.” It has been alleged that Huawei uses the same patented technology in its cloud engine series switches.
“Huawei provides a range of fully managed switches to manage and regulate the network traffic flow.” The accused products “deliver high performance, high port density, and low latency for cloud-oriented data center networks and high-end campus networks.” - Brazos
The reason for high performance is because these products reportedly “support an extensive range of data center features, Software-Defined Networking (SDN) capabilities, and high-performance stacking technologies.”
Huawei cloud engine switches allegedly utilize “every element” of at least claim 1 to engage in congestion management.
The accused products support a QoS (Quality of Service) model (DiffServ). DiffServ helps in classifying packets on a network into multiple classes. It also facilitates different actions for the classes.” The DiffServ model has numerous QoS mechanisms, such as congestion management and congestion avoidance.
This is how Huawei allegedly utilizes “every element” of at least claim 1 through the accused Products to engage in congestion management.
Thus, Brazos claims that Huawei has directly and contributorily infringed its registered patent. Brazos seeks declaratory judgment in its favour, an award for damages, an award for costs and fees, and other relief.
