Justice Amit Bansal, while delivering the order, observed that a prima facie case existed in favor of Jack Daniel's Properties, Inc. The Court noted that the registration of the respondent’s mark appeared to violate Sections 9(2)(a) and 11 of the Trade Marks Act, 1999, as it was likely to cause confusion and deception among the public and harm the petitioner’s goodwill.
