Sonu Sood's Plea Seeking Relief Against BMC Dismissed by Bombay HC

Bombay High Court dismissed the plea filed by actor Sonu Sood against the order of the trial court that refused to provide him protection from possible coercive action by the Brihanmumbaimumbai Municipal Corporation (BMC). The Bollywood Actor was concerned about a probable action on one of his properties located in Juhu. He had received a notice for unauthorised construction from BMC in this regard.

Sonu Sood's Advocate pleaded that the order passed by the lower court is erroneous as it failed to take into account the settled position of law.

He further argued that the order passed by city civil court incorrectly held that a speaking order by the BMC authorities was not necessary after a reply was filed to the notice under Section 53 of Maharashtra Regional and Town Planning Act.

According to his plea, the BMC order lacks clarity in terms of defining as to what constituted unauthorised construction. However, the counsel representing BMC countered the petitioner's claim by asseting that the actor had concealed the following two facts to run his illegal commercial hotel.

1. Alterations were carried out under the guise of beautification in contravention of the agreed layout plan.

2. The fact that the property has been demolished twice and reconstructed again was not brought before the Court.
