SCBA President Dushyant Dave Opts Out of Resolution Condemning Reddy's Actions

Andra Pradesh CM writes a letter to CJI 

The Andhra Pradesh government released a letter written by Chief Minister Jagan Mohan Reddy to the Chief Justice of India SA Bobde. The letter, put in the public domain on October 10, made explosive allegations about NV Ramana, the Supreme Court’s second-most senior judge.

SCBA passes resolution condemning actions of CM

The Executive committee of the SCBA held a meeting on October 16. In the meeting, the committee resolved to strongly condemn the actions of the CM. While the Executive Committee passed a resolution, the Supreme Court Bar Association’s President Dushyant Dave, opted out of it.

SCBA stated that CM Jagan Reddy should not have taken such a step because it will impact the independence of the judiciary.

"Such actions by constitutional functionaries are opposed to conventions causing serious inroads impacting the independence of the judiciary as enshrined in the Constitution of India."

On the other hand, in his communication to Acting Secretary, Dave registered his reservations against the body.

"At this stage, we would be pre-emoting the inquiry. I am sure at the end of the inquiry truth will emerge and if allegations are found false, SC must initiate contempt proceedings against the CM. Today it is premature to pass the resolution much less of the kind you all propose."

He added that the Judges "have a lot of explaining to do" while the bar remains a moot spectator despite a number of "disquieting developments" taking place on a daily basis. He also raised the issues of Judges being named in the suicide note of former CM of Arunachal Pradesh and the allegations of sexual harassment levelled against the ex-CJI Justice Ranjan Gogoi to support his contention.

"Judiciary is one institution which is completely opaque and no action is ever taken against erring Judges. SC of India is also not open and transparent."
