Petition in the Supreme Court Seeks Legal Action Against Justice Markandey Katju

Nirav Modi may be turned into a convenient scapegoat, says Katju

Justice Katju gave his deposition before a UK Court in the PNB money laundering case. He said that it is unlikely that Nirav Modi will get a fair trial back home in India and maybe turned into a "convenient scapegoat".

Following this, Nand Kishore Garg has filed a PIL in the Supreme Court seeking legal action against former Supreme Court judge, Mr Markandey Katju. The petition claims that Justice Katju's remarks bring disrepute to the Indian judicial system. His remarks tarnished the Indian judicial system's image "by insinuating the defamatory allegations while deposing before the foreign Court of Westminster magistracy of the United Kingdom".

Mr Katju’s remarks may affect public confidence: Nand Kishore Garg

The Petitioner claims that, by his remarks, Mr Katju cast aspersions on the Indian judiciary and the same would affect public confidence in the legal system.

In addition to the legal action, the petition prayed for a Court-monitored high powered committee to look into the former Judge's disparaging remarks.

Petitioner seeks guidelines on public criticism of judiciary

The Petitioner has also sought broad guidelines on issues concerning public criticism of judges and the judiciary by those who were once part of the judicial system and also for depositions and statements to be made before Courts of foreign countries.
