A Petition was filed in the Madhya Pradesh High Court challenging the amendment made by Madhya Pradesh Public Service Commission (MPPSC) on February 17, 2020 in MP PSC Rules 2015 in Rule-3 sub-rule (a) (d)
On February 2, 2021, The Division Bench of Chief Justice Mohammad Rafiq and Justice Vijay Kumar Shukla has accepted the petition for hearing and summoned the reply by issuing notice to the Madhya Pradesh Public Service Commission.
A resident of Jabalpur, Pramod Singh Sirsamhe filed the petition stating that the MP PSC Rules 2015 have been amended on February 17, 2020.
Rule-three sub-rule (a) (d) states that a candidate belonging to reserved class would be held in reserved class even if he scores the cut-off marks equal or more than the unreserved class in the preliminary and main examination.
The Supreme Court held in Saurabh Yadav v. Government of Uttar Pradesh that if the reserved class candidate carries the cut-off marks of the unreserved class, then he will be included in the unreserved category, argued advocate Yash Soni on behalf of the petitioner.
The High Court issued a notice to the state government and PSC after the initial hearing and submitted a reply. The Court also stayed the “selection process in the MP State Service Examination 2019/State Forest Service Examination, 2019 shall be subject to the final outcome of the writ petition.”
