Indian Union Muslim League Files Application Against CAA Rules

The Indian Union Muslim League (IUML) has filed an application before the Supreme Court of India challenging the Citizenship Amendment Act (CAA) Rules notified by the Centre on March 11. IUML is one of the parties who have challenged the CAA.

The primary point made in the interlocutory application is that presumption of constitutionality cannot be attached to a statute which suffers from manifest arbitrariness.

The application also argues that the implementation of the rules should be deferred as already the Act has not been implemented for the last 4-5 years.

The Citizenship Amendment Act (CAA), enacted by Parliament in 2019, aims to expedite Indian citizenship for non-Muslim migrants who fled persecution in Pakistan, Bangladesh, and Afghanistan and arrived in India before December 31, 2014. 

An amendment to Section 2(1)(b) allows migrants from these countries, belonging to Hindu, Sikh, Buddhist, Parsi, Jain, and Christian religions, to qualify for citizenship by naturalization after residing in India for five years instead of the previous requirement of eleven years.
