HCBA Resolves to Boycott Justice Rajiv Gupta's Court for Allegedly Misbehaving and Dismissing Cases Without Proper Hearing.

On Tuesday, The High Court Bar Association of Allahabad (HCBA) wrote to the Chief Justice of Allahabad HC, stating that they have resolved to boycott Justice Rajiv Gupta's court for allegedly 'misbehaving' and using 'abusive language' with lawyers and dismissing cases without a proper hearing.

This resolution was passed in a meeting presided by Vice President, Azeem Ahmed Azmi, and Secretary Prabha Shanker. During the meeting, it was alleged that the court of Justice Rajiv Gupta has been dismissing cases without hearing the parties and no time period was given.

The Emergency Meeting was called after Justice Rajiv Gupta denied to provide 2 days time to Advocate Swati Agarwal in a bail application - 8692/21 (Sanoj v. State). Swati Agarwal was representing the applicant and the court denied to permit any "pass over" in the matter and ordered her to immediately submit the documents.

Further, it was also stated by the members that the HCBA "requested the concerned court to reconsider its decision" and grant two days time in the concerned bail proceedings, but the same was declined.

Ultimately, the members conjointly passed a resolution stating that "it is nearly impossible to carry out the daily work before such courts and collectively the members resolve to boycott the court of Justice Rajiv Gupta (court number 75) till the further meeting."
