Doctor's Suicide Case: Co-convict Of AAP MLA Prakash Jarwal Moves Delhi HC

Another co-convict of Aam Aadmi Party (AAP) MLA Prakash Jarwal in Dr. Rajender Singh suicide case has moved to the Delhi High Court. The matter has been listed on October 18 for hearing.

In this case, AAP MLA Prakash Jarwal, Kapil Nagar and Harish Jarwal were convicted on February 28.

During the hearing before the trial court today, the counsel for Convict Kapil Nagar sought an adjournment on the ground that Nagar has moved to the High Court.

Thereafter, Special Judge Kaveri Baweja listed the matter for hearing on October 21.

Justice Amit Mahajan on September 27 summoned the physical trial court record.

Earlier, on August 30, Justice Amit Mahajan had quashed the order of conviction of Harish Jarwal on the grounds of settlement arrived at with the complainant on August 10.

Harish Jarwal had challenged the judgement of February 28, passed by the Rouse Avenue Court.

He was convicted for the offence under Section 506 (Criminal Intimidation) of the IPC and the same is compoundable at the Instance of the person so intimidated.

Senior counsel Ravi Sood, along with Saurabh Agarwal for the petitioner, has submitted that he petitioner has only been charged and convicted for the offence under Section 506, Part-I of the Indian Penal Code, 1860 ('IPC').

After hearing submissions of counsel and respondent, the High Court had allowed petition and set aside the judgement of conviction of February 28, to the extent of the petitioner's conviction, subject to payment of a total cost of Rs 30,000 by the petitioner, to be deposited with the Delhi Police Welfare Society within a period of eight weeks from today.

The High Court had said that since the state machinery has been put to motion and the settlement has arrived at such a belated stage, ends of justice would be served if the petitioner is put to cost.

An FIR was registered at Police Station Neb Sarai in 2020 in this case.
