Delhi HC Rejects Plea Against Approved Merger Between Tata SIA Airlines, Air India

The bench of Justice Sanjeev Narula said the claims made by the petitioner appear to be designed to manipulate or mislead

The Delhi High Court has dismissed a plea challenging the Competition Commission of India's (CCI) rejection of objections to the merger between Tata SIA Airlines Limited and Air India Limited.

CCI had earlier dismissed the application noting the absence of any substantive evidence to back these allegations. Consequently, through an order dated December 15, 2023, the application was closed under Section 26(2) of the Act by CCI, noted the Delhi High Court.

The bench of Justice Sanjeev Narula said the claims made by the petitioner appear to be designed to manipulate or mislead.

"The claims are made without any regard for truth and appear to be designed to manipulate or mislead. This approach not only discredits the Petitioner's credibility but also burdens the legal system unnecessarily. Therefore, in the Court's view, given the absence of any substantiated claims and the apparent malicious intent behind the allegations, the present petition lacks merit." said the court.

Therefore, in the Court's view, given the absence of any substantiated claims and the apparent malicious intent behind the allegations, the present petition lacks merit. In light of the above, the present petition, along with all pending applications, is dismissed, said the Court.

The Court further noted that the instant petition assails the impugned order rejecting the petitioner's application. The petitioner contends that the CCI issued the impugned order without conducting any inquiry.

Additionally, the petition includes numerous unsubstantiated, wild and scandalous allegations against the Prime Minister and a former Chief Justice of India, none of which are supported by documentary evidence.
