The Delhi High Court recently quashed an FIR lodged against a person over non payment of outstanding bills to hotel Leela Palace for his stay. The High Court quashed the FIR considering the facts that the matter has been settled between the parties after the accused had paid the bills to the hotel.
An FIR was lodged at Police Station Sarojini Nagar in 2023 on the Complaint filed by the hotel official.
Justice Anish Dayal quashed the FIR lodged against Mahamed Sharif after considering facts and submissions.
"Considering the above settlement between the parties and. the chances of conviction of the petitioners being remote and bleak, there is no use continuing with proceedings of the present FIR as it would be a misuse of the process of the Court and an unnecessary burden on the State exchequer," Justice Anish Dayal said in the order passed on September 26.
The bench noted the submissions of the authorised representative of the complainant Hotel Leela Palace who was presented in the court. He stated that they have no objection to quashing of the FIR in view of payment by the accused of their outstanding dues.
"Accordingly, the petition is allowed and FIR and proceedings emanating therefrom are quashed," Justice Dayal ordered.
Mahamed Sharif had moved a petition through Advocate Samar Khan seeking quashing FIR on based on settlement as recorded by the parties before the trial Court on February 2. 2023.
This FIR was lodged over non-payment of outstanding dues for stay at Hotel Leela Palace, New Delhi by the petitioner. The authorised representative of the complainant Hotel Leela Palace was present before the trial court and stated that accused had settled all the outstanding dues and they have no objection to grant of bail and accordingly, bail was granted to accused.
