The Delhi High Court recently reprimanded social media platform X Corp (Twitter) for challenging a court order to remove posts by Congress leaders accusing journalist Rajat Sharma of using abusive language against Ragini Nayak on live television.
Bench comprising Acting Chief Justice Manmohan and Justice Tushar Rao Gedela emphasised that it should function as a neutral platform and comply with court orders.
Justice Gedela questioned why X Corp would oppose the order, especially when someone's reputation was at stake. X Corp's representative, Senior Advocate Rajshekhar Rao, argued that the platform had no personal stake in the matter and emphasised the need for a structured process.
As per reports, the division bench said: "We are a bit concerned about your locus. You are not behaving like an intermediary. You must behave like a neutral platform... We are finding increasingly on the original and the appellate sides that the Domain Name Registrars and intermediaries are refusing to comply with court orders. It is not only a national trend but international. Even Canadian court's orders have been not complied with."
Rajat Sharma had filed a defamation suit seeking ₹100 crore in damages.
