Delay In Appeal: SC Directs Trial Court To Release Murder Accused On Bail

The Supreme Court has directed a trial court to release a murder accused on bail in an Arms Act case. 

The convict has reportedly already undergone actual imprisonment for over 15 years.

Interestingly, the said appeal is pending before the Allahabad High Court for 12 years. 

As per PTI's report, the the apex court has affirmed that a case attracts the provisions of Section 389 of Code of Criminal Procedure. 

The said provision allows the accused to approach the Court for suspension of the sentence pending an appeal.
