Additional sessions judge LS Chavan, dismisses a notice of motion filed by actress Kangana Ranaut in a suit challenging a notice issued by the Brihanmumbai Municipal Corporation in relation to alleged unauthorised works carried out by the actress at her residential building at Khar, Mumbai.
City Civil Court Extends Ad-Interim Protection by 6 weeks
Bombay City Civil Court at Dindoshi, extended the ad-interim protection given to Kangana so that she can challenge the dismissal order in Bombay High Court. Earlier the judge had restricted the BMC officials from taking any coercive step against the actress's property in furtherance of the notice till her application was decided by the court.
Notice not in accordance with law
The ad-interim protection provided to her was extended for 6 weeks that gives her her time to mover to the High Court. Kangana Ranaut through her application claimed that the notice served to her was vague and didn’t specify the very nature of the alleged unauthorised construction. Further, she argued that the order issued to her was not in accordance with the law.
Bombay HC had quashed BMC's Notice alleging unauthorised works
The Bombay High Court in November had granted her relief in the matter where the BMC officials had demolished a portion of her property located at Bandra, Mumbai for alleged unauthorised works. The High Court had quashed the demolition notice served by BMC and stated that Kangana can make her property habitable again.
