Allahabad HC Seeks State's Response On Demolition

An order was passed by the Additional Collector (Land & Revenue) on July 22, 2024, pursuant to which the house in question was demolished by the state authorities

The Allahabad High Court recently sought state's response on a plea against illegal demolition of a house in the Azamgarh district.

An order was passed by the Additional Collector (Land & Revenue) on July 22, 2024, pursuant to which the house in question was demolished by the state authorities.

A report was submitted in this case to the Assistant Collector and after giving due opportunity to hear the house owner and finding his response insufficient, the order for the said demolition was given.

The house owner had even appealed the decision of the Assistant Collector. However, the Additional Collector upheld the order passed by the Assistant Collector.

Bench comprising Justice Prakash Padia directed the standing counsel for the state to file an affidavit explaining the circumstances under which the said demolition was carried out.

The Supreme Court of India has also taken cognisance of widespread demolitions being carried out by state governments and contemplated national guidelines on the same.
