Allahabad HC Protects a Married Couple From Continuous Harassment of Police After Invocation UP Prohibition of Unlawful Religious Conversion Ordinance

On Wednesday the Bench of Justices Saroj Yadav and Ritu Raj Awasthi provided protection to a married couple who alleged that the police was continuously harassing them since the recent ordinance on religious conversion was invoked in the state. Questions were raised on the FIR registered against the couple under section 363 and section 366. The petitioners stated that they have been forced to move to Court because of the continuous harassment inflicted by the police after the invocation of the recent Religious Conversion Ordinance. They also questioned the FIR lodged against them under Sections 363 and 366 of IPC.

“Have married out of their own sweet will three years back and they are living peacefully and enjoying their matrimonial life”: HC 

The bench in view of the petitioner's contention  said that “considering the entire aspect of the matter, it is hereby provided that till the next date of listing, the petitioners shall not be harassed by the police on the basis of the impugned F.I.R." 

The bench also passed an order stating that  the petitioners have married out of their own sweet will three years back and they are enjoying their matrimonial life." The bench was also informed that the petitioners also have a one and half-year-old child.    

The High Court has given a one week's time to the State to obtain instructions and posted the matter for hearing thereafter.
