Petitions were filed in Allahabad High Court to stop the airing of the web shows Paatal Lok and XXX- Season 2. The two shows have courted controversy in the recent past as well.
The petitions sought to stop the airing of web-shows Paatal Lok and XXX- Season 2
"Palaal Lok" violates fundamental rights enshrined under Articles 25 and 26 of the Constitution
The petition filed against the telecast of web series "Paatal Lok" stated that it the series offends the principles of "Sanatan Dharm" and also violates fundamental rights enshrined under Articles 25 and 26 of the Constitution of India.
The Division Bench of Chief Justice Govind Mathur and Justice Siddhartha Varma dismissed the petition out rightly. The Court rather advised the portioner to make a representation before an appropriate government authority.
Petitioner must approach competent authority
The Court gave the same order while dismissing the petition against the airing of the web-series "XXX-Season 2".
The Court noted that the petitioner has not assisted the Court on the applicable law and the competent authority of the Government had not yet been approached over the issue.
"It also reveals from a perusal of the averments contained in the petition for writ that before approaching this Court under Article 226 of the Constitution of India, the petitioner has not made any demand from the Authority competent to take necessary measures as claimed in this petition for writ. It is a settled principle of law that the person demanding writ in the nature of mandamus is first required to make a demand from the Authority competent." - Allahabad HC
