A Note Of Remembrance: K. K. Sud, Senior Advocate

Sud was nominated by Delhi High Court for his elevation as a judge of Delhi High Court. Being a very popular and sought-after lawyer and his enigmatic persona, he contested and won the elections for the Delhi Bar Association for the post of Secretary, winning by a thumping majority

K.K Sud, a Senior Advocate of the Supreme Court of India, is regarded as one of the leading lawyers of his generation. From the very start of his career as a lawyer, he had a patriotic view and a strong belief in the Indian judicial system.

His commitment to the cause of the nation and pride of being a Hindu brought him in contact with the stalwarts of RSS and BJP. He worked relentlessly during several elections and was the election officer of Late Kedarnath Sahni. His popularity, responsibilities and involvements with the party increased for which he was numerous times recorded/bestowed with honour and recognition.

Rise to Prominence:

His first tryst with the oppression and excesses committed by the INC during the Emergency of 1977 was legally defended by him in securing bail for various prominent leaders of the RSS and BJP who were sent to jail on false frivolous allegations.

K.K Sud, during that tenure, made several jail visits to meet those leaders incarcerated in jails as their legal representative. The prosecution was unable to successfully counter the arguments and legal submissions made in court for the release of the detainees with a view to stall such arguments and wide reporting in newspapers finally decided to issue and arrest warrant even against him. As advised by the leaders-in-charge at the time, K.K. Sud was sent into hiding with a view to avoid his unlawful arrest.

In recognition of his service to the country and fight for removal of the anarchist INC regime K.K. Sud was bestowed the honour of being made the Advocate General (Standing Counsel-Criminal) for the Union Territory of Delhi. He performed his duties diligently and with utmost sincerity. Furthermore, he was nominated by Delhi High Court for his elevation as a judge of Delhi High Court. Being a very popular and sought-after lawyer and his enigmatic persona, he contested and won the elections for the Delhi Bar Association for the post of Secretary, winning by a thumping majority. He also contested for the post of Member of Bar Council of Delhi (Statutory Body) and remained a member of the bar council for more than 15 years, he was the first Chairman of the prestigious Bar Council of Delhi with the leaning to the RSS and BJP.

On the eve of 6th of December 1992, he was summoned by the party leaders L.K Advani and Murali Manohar Joshi, who had been put under arrest/detention on account of the alleged dispute over the birthplace of Ram Lalla a.k.a, The Babri Masjid Case. As an obedient soldier, despite all obstacles on account of there being a nationwide curfew, along with his legal team, managed to reach Akbarpur where all the leaders were detained. After several days of arguments, he finally succeeded in getting bail for all the leader detainees, including Vishnuhari Dalmia, Kumari Uma Bharti, Baba Sahib Thackare. As an acknowledgment of his legal triumph despite all odds and an adversarial government in the centre, he was bestowed with honour by both RSS and BJP. While he was contesting the legal battle at Akbarpur, he was also appearing and arguing for numerous other RSS leaders arrested in Delhi courts. 
During the tenure of Late Madanlal Khurana (CM of Delhi), he was actively involved in appointments of lawyers for representation of the Delhi government before the courts. He was nominated to be a director of the Board of the ITDC, under whose regime at the time, the policy of “disinvestment” of government monies from properties of ITDC was initiated.

That, yet again an attempt was made by the central government to implicate the prominent leaders of the BJP in a false frivolous case called “Jain Havala Diaries”. He successfully procured bail for all the prominent leaders falsely accused in the above case. He successfully got the FIR quashed against L.K Advani from the Delhi High Court, which was even upheld in the Supreme Court. In the meantime, he regularly appeared at Rai Bereilly in the Babri Masjid trial. He visited more than ninety times that year, along with his son, Jayant K. Sud. The trial court was pleased to discharge the L.K Advani and Shri Murali Manohar Joshi. The CBI went in appeal against the discharge which was successfully upheld by the trial court and even by the High Court of Delhi.

The Adhivakta Parishad, which was more or less a dormant organization was successfully revived under his leadership. Office bearers of repute and dedication were absorbed in the organization, the benefits of which are evident till date. During Shri Atal Bihari Vajpayee’s tenure, K.K. Sud was appointed as the Additional Solicitor General of India (ASG), which office he held till 2003.
