Victim's And Her Father's Contradictory Evidences In Jharkhand POCSO Case

In the case of State of Jharkhand V Emerencia Lomga, Special Judge Prabhakar Singh based his judgment on the fact that the evidence of the 8 year old girl child victim was not trustworthy and did not inspire the confidence of the Court even though the victim said she was sexually assaulted and the medical evidence supplemented the same. 

The Vice Principal and the nurse who were the accused in this case along with the class teacher of the girl's class and others were acquitted because of the failure of the prosecution to establish the fact in a truthful manner and most of the evidence was fabricated or exaggerated.

The victim’s words had certain contradictions and the victim’s father’s evidence did not have any factual stronghold. The defense Counsel could therefore establish the grave contradictions and based on doubt, the Special Judge had acquitted the two accused people
