The Supreme Court bench comprising Justice Aravind Kumar recently issued notice on the transfer petition filed by Actor Manoj Bajpayee to transfer his defamation case against Kamaal R. Khan to be transferred from Indore to Mumbai. Khan had earlier tweeted certain defamatory tweets against Bajpayee in which he called him Charsi/ Gangedi.
It has been submitted on behalf of Bajpayee that Khan repeatedly posts defamatory tweets against celebrities and proceedings against him have taken place several times.
The counsel appearing on behalf of Khan supplicated before the court to grant an interim stay on the arrest warrants issued against him by the Indore Courts. But the court did not grant the stay and asked Khan to appear before the Indore court for the proceedings.
The counsel on behalf of Khan submitted before the court that since both the parties hail from Mumbai the court in Indore does not have the jurisdiction and hence the matter should be transferred to Mumbai. But it was submitted on behalf of Bajpayee that Khan has not put forth before the court that he had also approached the Madhya Pradesh High Court for the transfer of the case but after his plea was dismissed, he approached the Apex court.
The bench issued notice on the petition and directed the counter affidavit to be filed within two weeks and the rejoinder affidavit to be filed a week after that. The matter will be listed after three weeks.
