The Aam- Aadmi Party( AAP) had filed its representation before the Election Commission of India( ECI) for being granted the status of a national party last year. In accordance with the Section 6(b) of the Election Symbols (Reservation and Allotment) Orders of 1968, AAP which has established its governments in Delhi and Punjab and has more than 6 percent shares of votes in Goa and Gujarat is eligible to be granted the status of a national political party.
The representation which was made back in December, 2022 by AAP with follow up reminders in February and March, 2023 did not find luck with the ECI, pushing the same under review and therefore AAP moved the High Court of Karnataka ahead of the Legislative Assembly Elections that is scheduled to be held on 10 May 2023.
The High Court bench of Justice M Nagaprasanna has ordered that the ECI must give its decision by 13 April 2023 and this must be done by an independent and transparent assessment procedure in accordance with law.
