Consumer Court Sentences Delhi Builder For 182 Years

Delhi High Court extended the parole of a petitioner under Article 226 of the Constitution of India read with section 482 Cr.P.C

It was submitted and argued by the Counsel of the Petitioner that after the Parole was rejected by the competent authority, the Petitioner had filed a Writ Petition in 2019 and was released on parole for a period of 30 days. 

Counsel for the Petitioner submits that the Parole was extended from time to time by the Co-ordinate bench of the Delhi High Court and further submits that the present case is peculiar in nature whereby the sentence awarded by the Consumer Forum if taken cumulatively is 182 years and the petitioner is making efforts to settle the matter. 

On notice, Sh. V.K. Tandon, appeared on behalf of Respondent No.2 also stated that the Petitioner is making efforts to settle the matter and his parole may be extended.

Counsels for the Petitioner even submits that the Petitioner has made sincere efforts to receive enhanced compensation against the land acquired from the Ghaziabad Development Authority and this money the Petitioner undertakes to pay to the Complainant. It was further brought to the attention of the Court, the Affidavit of the District Magistrate, Ghaziabad in which it has been deposed that the Petitioner has filed an application under Section 18 of the Land Acquisition Act,1894. 

It was further stated that despite the Affidavit from DM the enhanced compensation has yet not been released. Petitioner has filed a writ petition in the Allahabad High Court. 

The Court granted Parole to the Petitioner for a period of six months on furnishing a personal bond of Rs 20,000/- with one Surety of the like amount to the Satisfaction of the Jail Superintendent.
