In a major legal development that surprised people across quarters, a complaint alleging misuse of official position was moved against Justice D. Y. Chandrachud by one Rashid Khan Pathan and two other persons. The complaint letter was sent to the Chief Justice of India Uday Umesh Lalit.
The complainants alleged that Justice Chandrachud had passed certain directions in a case which was purportedly connected with proceedings in which his son had appeared before the Bombay High Court.
It was also alleged that Justice Chandrachud overlooked the settled law while dismissing a petition which challenged restrictions which were put on people who had not got Covid Vaccine administered on themselves.
The Bar Council of India, while dismissing and calling the letter malicious, said that, "it is nothing but a scurrilous and malicious attempt to interfere with the functioning of Judiciary and the administration of Justice."
"The country and the Indian Bar has complete faith in Dr. Justice D. Y. Chandrachud. Hon'ble Dr. Justice D. Y. Chandrachud is an asset for the world's Judiciary and is known for his knowledge, honestly and integrity," the Council stated.
The allegations have been levelled close on the heels of Justice Chandrachud assuming office as the next Chief Justice of India.
BJP leader Subramanian Swamy tweeted, "I am surprised there is any doubt about Justice Chandrachud becoming the next CJI. Hence why bother about letters written by anybody high or low. The hallowed principle of succession for ensuring confidence in the judiciary, is that the next senior most judge becomes CJI."
