Allahabad HC Grants Bail To Man Charged With Capturing And Circulating A Video Abusing UP CM Yogi Adityanath

The Allahabad High Court bench comprising Justice Ajay Bhanot recently granted bail to Sujeet Sharma in a case of making a video hurling abuses at the Chief Minister Of Uttar Pradesh, Yogi Adityanath. He has been charged under sections 504, 506, 386 of Indian Penal Code and Section 66 of Information Technology Act as well as Section 3/25 Arms Act. The bail applicant had been in jail since October 21, 2022.

The bail application of the Appellant had been rejected earlier by the trial court.

It was submitted on behalf of the applicant that he was induced into drinking by the co- accused persons and then may have blurted out objectionable words under the influence of liquor. It was further submitted that the video was captured and circulated without the knowledge and consent of the applicant.

It was put forth by the counsel appearing on behalf of the applicant that he doesn't have any criminal history and is not at a flight risk. It was put forth that there is no risk of him influencing witnesses, tampering with the evidence or reoffending. 

The court observed that the submissions on behalf of the applicant were not satisfactorily refuted by the ASG and without making an observation on the merits of the case, bail was allowed.

The High court directed that the applicant is to be released on bail on furnishing a personal bond and two sureties each in the like amount to the satisfaction of the trial court. The high court also imposed the condition that the applicant will not tamper with the evidence or influence any witness during the trial. The applicant also has to appear before the court on fixed dates.
